If selected, Dancing for Memories, agrees to provide you with a Hoyer AY02 Electric transfer lift assist device (the "Product"), intended to aid individuals in mobility and daily living activities. The Product is provided as a gift and is not in exchange for any compensation. The Recipient acknowledges and understands that the use of the Product involves certain inherent risks, including, but not limited to, physical injury, damage to property, or other potential hazards. The Recipient hereby agrees to release, waive, discharge, and hold harmless Dancing for Memories, its directors, officers, employees, volunteers, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Recipient or to any property belonging to the Recipient, whether caused by the negligence of the Charity or otherwise, while using the Product. The Recipient agrees to assume full responsibility for any risks, injuries, or damages, known or unknown, which might occur as a result of using the Product. The Recipient agrees to indemnify and hold harmless the Charity from any loss, liability, damage, or costs, including court costs and attorney's fees, that the Charity may incur due to the use of the Product by the Recipient or by any other person using the Product with the Recipient's permission.
